Free Concept Terms
The terms that apply when you request a free homepage concept and site check. Last updated 2 October 2026.
In short: the site check is yours to keep with no strings. The homepage concept stays mine until you commission it, and it is for you to evaluate, not to hand to another designer or developer to build.
1. Who these terms are with
These terms apply when you request a free homepage concept and site check from Branding Marketing UK Ltd, trading as Terence Meghani ("I", "me", "my"), through terencemeghani.com. By ticking the box on the request form you accept these terms. They sit alongside, and do not replace, the privacy notices and the site Terms of Use. Where these terms and the Terms of Use conflict in relation to a free concept, these terms apply.
2. The site check
The automated site check is yours in full, free, with no obligation. You may act on it, share it, pass it to another supplier, or ignore it completely, whether or not you ever work with me. It is produced automatically from your homepage, it is not a full technical or SEO audit, and it is provided without warranty. Nothing in it should be relied on as professional advice.
3. The homepage concept: ownership
The concept is original design work produced specifically for your business.
- Copyright and all design rights in the concept remain mine at all times. Providing the concept, discussing it, or inviting your feedback on it transfers nothing to you.
- No ownership passes on any future date by implication. Any transfer of copyright would require a separate written assignment signed by me, and none is given by these terms.
- This applies whether or not you pay anything, and whether or not you go on to commission work.
4. What you may and may not do with it
You are granted a non-exclusive, non-transferable, revocable licence to evaluate the concept only. That means you may view it, and discuss it internally with your own colleagues, partners or board, for the sole purpose of deciding whether to commission the work.
You may not, without my prior written permission:
- Publish, launch, or otherwise use the concept or any part of it;
- Copy, reproduce, adapt, or create anything derived from it, including recreating its layout, structure, or bespoke graphic elements in another tool or template;
- Supply it, show it, or describe it in detail to any other designer, developer, agency or contractor, whether to obtain a competing quote, as a brief, or as a reference for work to be carried out by someone else;
- Share, forward or publish your private preview link, or any screenshot or export of the concept, outside your own organisation;
- Remove or obscure any credit, watermark or notice on it.
The concept, and the preview link, are confidential to you and me.
5. If that is not followed
Using the concept outside the licence in clause 4 is copyright infringement. If it happens I may, at my discretion and without affecting any other right or remedy: require you to stop and to remove the material; charge a licence fee at my standard design rate for the work as used; and pursue the remedies available to a copyright owner, including an injunction, damages or an account of profits, and costs.
Taking the concept to another supplier to build is the specific case this clause exists for, and it is not a grey area.
6. Third-party materials
A concept may show typefaces, photography, icons or other assets licensed to me, or used as placeholders for illustration. Those licences are not passed to you. If you commission the work, the correct licences for your use are arranged and costed then.
7. What is not restricted
So that clause 4 is not read more widely than intended: I do not claim ownership of your brand, your logo, your copy, your photographs or any other material you supply, and nothing here limits what you may do with those. Nor do I claim ownership of general design conventions, layout ideas, or common techniques. What is protected is the specific concept as expressed, not the ideas behind it.
8. No obligation on either side
Requesting or receiving a concept does not commit you to buying anything, and does not commit me to taking on the project. It is not a contract for services. If we go ahead, a separate quote and the site Terms of Use will govern that work.
9. How long it stays available
I may show you the concept on a call first and send you a private preview link afterwards. The link stays live for 30 days from the date I send it. After that I may take it down. Ask me if you need longer. I may withdraw a concept at any time, and may decline a request without giving a reason.
10. Your information
I use the website address, name, business name and email you submit to produce your site check and concept and to contact you about them, and for nothing else without asking you first. See the privacy notices for the full detail and for how to ask me to delete it.
11. Liability
The concept and site check are provided free and as is. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, I am not liable for any loss arising from your use of, or reliance on, a free concept or site check.
12. Changes and governing law
I may change these terms; the version that applies to your request is the one published when you submitted it, and the date at the top of this page tells you which that is. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
